Legal regulation of the activities of banks

The subject matter of this thesis is to approach prudential requirements for banking activities in the Czech Republic. Taking into account the importance of the banking sector in the economy of each country, this area is widely regulated by directly applicable European legislation, for example by new regulation (EU) No. 757/2013 of the European parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and investment firms. National regulation is contained mainly in Act No. 21/1992 Coll., on Banks, as amended. Particular chapters of this thesis focus first on general introduction to banking, i.e. a description of the banking systems and institutions operating in them. One part is devoted to the Czech National Bank as the institution of the financial market supervision. The main part describes specific rules of banking activities, beginning with requirements for obtaining a banking license. Finally are mentioned financial safety net and the issue of the doctrine too- big-to-fail. Diploma thesis tries to connect the theory and the legislation with the practical functioning of supervision. Relations of the central bank to commercial banks Abstract The thesis follows up the relations of the central bank towards commercial banks, with the main emphasis being placed on the Czech Republic, where the role of the central bank is carried out by the Czech National Bank. The main aim of this work is to describe and evaluate the relations between these institutions in terms of current legislation and focus on situations where this legislation does not evolve in the right direction. The first part of the thesis is theoretical and deals with the definition of institutions crucial for the topic itself. By both institutions, commercial banks and the central bank, are emphasized their legal anchoring and their main activities. Within this part, a separate chapter is devoted to the Czech National Bank and its independence, without which CNB would not be able to carry out its activities properly. This part will also analyze the banking system, which represents a summary of banking institutions in a certain state and a summary of individual links between them. The system of banking regulation and supervision in the Czech Republic with a view to licensed entry in the banking industry

This bachelor thesis deals with the banking regulation and supervision in the Czech Republic and is focused on licensed entry in the banking industry as the basic part of the system of banking regulation and supervision. Attention is devoted to the current legal regulations of banking license including the conditions of its obtaining and the uniform license principle that is applied in the member states of the European Union. This thesis describes also the possibilities of banking license extinguishment. The aim of my thesis is to make an integrated overview of this dilemma and to review the need of regulation arrangement. For that purpose is the last part of the thesis dedicated to the regulation development in the Czech banking system since 1990 until present with the sight on the changes in license administration area.
